I didn't realise it was a civil case.
Why is fraud civil?
On what basis is NY bringing the case? Is it them who suffered the loss, or is it like R v xxxx?

Proven claim is he knowingly inflated his net worth and the value of his assets in order to deceive banks and other eventual business partners into giving him bigger benefits.
It’s like someone adding a zero to their paycheques and bank accounts, then getting a hundred year mortgage on a landmark property because the bank is convinced they’re a safe investment.

Trump fraudulently over valued his properties when using them as collateral for loans. He claimed his own penthouse in Trump Tower was worth $600 million while others say it worth less than third of that. His son claims Mar a Lago is worth over a billion but independent contractors say approx 75 million tops.
At tax time Trump would claim they were worth much less.
All of these claims of his are well documented in loan agreements and tax filings. -

The fairest resolution to this affair would be to restructure the loans based on the values he gave for tax purposes and recharge tax based on the values he gave for loan purposes.

And as it's fraud, why is it a civil case instead of criminal? And will there be a subsequent criminal trial depending on the outcome of the Civil trial?

It is not a normal fraud case. Rather, it was brought under a powerful New York statute that gives the attorney general wide scope to investigate and prosecute corporate fraud.

Legally, they’re two separate realms, and the one wouldn’t impact on the other. Realistically, the civil sentence will probably weigh on the political decision to prosecute him for fraud charges or not. Not that it’s a desirable scenario, but there’s blood in the water now, and people who want a chunk of what trump has might feel rushed to take action now lest he’s ruined before they get theirs. That includes the taxmen for the State and City of New York.

Someone who's been let down by the system time and time again and see zero value in paying taxes cause they never get any value back from the state. Having spoken to a few Americans that grew up outside the main cities, I can kinda understand where they're coming from. I wouldn't draw the same conclusion from their experiences, but I can follow their reasoning.
