He hasn't failed a test, as far as I can tell, so it's not a case of checking his b sample and then opening a case if it is positive. It reads like the authorities in Spain have evidence of doping practices operated by Dr Marcos Maynar and have been able to link Lopez to that.
The delay is probably due to having to collate all the evidence and build the case.

Might be the charges were placed in a jiffy bag and then lost or something?
