  • You can’t exclude legal liability for death or injury from negligence in English law.

    Whether the contracts are under English law or not, who knows - esp if the possible negligence is in international waters?

  • Same goes in (some) Civil Law traditions. Businesses aren’t fined for including the clause, and it might stop someone from suing, so they all try their luck at preemptively washing their hands of any responsibility.

    More people need to know that crap doesn’t tend to work out in court. (This is not legal advice)
