I'm not a lawyer obviously but I think sampled drums are a bit safer than sampled melodies / chords.
I was using some Native Instruments sample packs at the weekend and I noticed a load of very obvious drum samples - the Amen snare was throughout it - and NI sell those samples as an original production pack!
MJ is a spicy meatball to try that on though. Safest thing would be to remove/recreate it if you can do it without it messing up the sound.
