The drive side drop out was worn so the wheel would touch the non drive side chainstay just behind the bottom bracket. This happened always and not just under load.
I'm not sure what the repair entailed bit it was done by a company here in Ireland called Altitude. It was well finished and has solved the problem.
If it had of been my own bike I would have went at it with the file.

What’s the symptom and fix of a worn dropout? My CAAD7 rear wheel doesn’t sit perfectly straight, rim is closer to NDS seatstay than DS… tempted to file the NDS slightly to bring that side forward.
