They can’t make you give it back. But, legally, if something bad were to then happen, you’d probably not have much of a leg to stand on.

Because I always wonder things like this; what do people think r und m would do if a customer refused to give their P70 back. Could a customer hold them to ransom over it? Would r und m be able to leave one out their in the world?
My guess is the owner assumes liability and possibly even renounces their warranty on the bike.
