The Dutch company will not be going to court (they implied), they just want recognition for the invention/design. The patent is not valid in Japan, they only applied in western countries, as you have to apply per country) and I'm also not sure about the revenue that Hope/Lotus makes out of this bike. And they don't want to be sued by Hope/Lotus in the future of course.
I don't know anything about patent law, I guess it depends what exactly is covered. Lotus bike has a 'traditional' bar/stem setup compared to the Kú one that has the bars and stem all integrated into the design.
