looks like it, but afaik patents are a very tricky business, so who knows there will be a loophole after all. This article (google translate) says a patent request from Team GB was rejected last March.

I don't know anything about patent law, I guess it depends what exactly is covered. Lotus bike has a 'traditional' bar/stem setup compared to the Kú one that has the bars and stem all integrated into the design.
