Ah, well if that's the rule then yes, I agree with you.
Unfortunately, this is a "UCI rule" which is basically as good as the toilet paper it's shitted on.
If the UCI actually applied their rules, none of the current Hour Record holder would hold the Hour Record.

What's the penalty though? Let me guess - up to the commis?
Also, it could be argued that a wayward rain jacket is a danger and therefore it was in the interests of rider safety that it was thrown away.
