Is this legislation now possible because of brexit\could this have been done if we were full EU?

Nothing to do with Brexit.
My MP wrote back to my complaint about the protest bit of the bill saying:
1. it was very important that it should pass to it could stop Bad Things but also I shouldn't worry because it was just codifying existing law.
2. people could invoke their human rights if they felt hard done to
  Pretty weak sauce even by her standards
