Anyone leaving a Tier 3 area before midnight was breaking the rules because you weren't allowed to leave a Tier 3 area and stay overnight before 23 December, which was then reduced to not at all. It wasn't a technicality, so she doesn't have a leg to stand on really.
My upstairs neighbour went early last night following the same 'get out before Tier 4' thinking. What this will result in is a greater risk of Covid spread because the longer you spend inside / living with someone the more likely you are to spread it.
If you're going to break the rules there's really no rush.
There's exemptions if you're in a support bubble (and they still apply to tier 4). You're allowed to travel and stay over within that bubble at any point.
