It's a deliberate conflation between the very rare late-term abortions (circa 1% and usually only for late-diagnosed fetal abnormalities) which are after 21 weeks, and the phrase late-term pregnancy used to mean 40+ weeks. It's really unhelpful to have the same phrase used in both situations and allows Trump et al to talk about babies being executed even after due date which just does not ever happen.
