  • If you are caught taking drugs then you are by definition caught in possession of a controlled substance.

    If you are arrested for being high when not in possession the police would have to prove that you were, at some point, in possession of the substance that got you high. I'm sure they've got bigger fish to fry. If they try to prosecute you for the act of being high then it's pretty easy to say something along the lines of; my drink was spiked / someone gave me a cookie to try it tasted a bit funny.

  • The main three acts covering misuse of drugs don't define taking drugs as a form of possession and a quick check of some UK lawyers web sites state explicitly that taking drugs is not illegal in the UK so I think it might be more nuanced than that. Even the Guardian summary of UK drug law says taking drugs is not an offence in itself. This, and based on previous experience, is why I am suprised to see the Gov.uk site saying you can get fined or imprisoned for taking drugs.

    I know there was a really big battle over avoiding criminalising drug users when the relevant laws were thrashed out.

    Perhaps taking drugs while under some form of order?

    I'm going to bother a lawyer over this because I'm genuinely interested.

  • It is interesting. You're right that the gov.uk website seems to be the outlier, but it wasn't in the drugs and driving section, just in the generic section.

  • (Re Starkey). The missed points here are epic. It’s amazing how plainly stupid someone so academically successful can be! To seem not to understand the notion of tone of voice or concept whole bemoaning ones wasted career and thinking it’s all gone away because of one word! Which single word is he referring to? “Blacks”? Or “Damn”? Because it’s the fact that those two words as a phrase exist in his vernacular that offends me... but what do I know?

  • Closer to home than that. Relative by marriage that is recognised as a world-class intellect & academic, and yet is so stupid that it burns.

  • I have a relative like that. World reknowned physicist with a thirty year career at Nasa and US DoD, thick as mince in all other areas other than physics.

    I wonder if these people are just a bit thick, eccentric, or if they are smart enough to know that they are basically protected and untouchable due to having valuable skills that are in such demand so there is literally no benefit to them in engaging with 'lower level life' and attaining actual life skills.

  • Never thought it was that cynical. But maybe it is.

    IME it mostly seems to be a lack of thought towards things outside their niche area. Sometimes they find it boring so why amalgamate it into your knowledge bank?

    I know "common sense" isn't popular here, but it always seems to be that which is missing. Just those things that you intuitively pick up on or can see.
