Freeholder retains the garden, lessees are given a non-exclusive right to use the garden in their leases. Same as in larger purpose-built blocks of flats.
From the look of it (one dead tree in a pot and lots of suspicious looking bushes) it doesn't look like it's been used much by anyone.
