Pedestrian crossings

Checked the Highway Code, just to see what the score is because I'm heartily sick of peds looking straight at me then stepping off the pavement anyway.

The Code states "always check that the traffic has stopped before you start to cross or push a pram onto a crossing" which makes sense, and is helpfully aimed at the kind of chav scum that think they can use their malnourished bastard mewling brat offspring to bring traffic to a halt

It then goes on to say "Remember that traffic does not have to stop until someone has moved onto the crossing."

Which looks kinda contradictory to me.

Yes, but of more concern to me are the peds that aren't using a crossing!
There's no jaywalking law here apparently so that means what? Peds are always right, even if their dopey ipod-wearing, mobile phone chattin', wrong way looking arses step out in front of you dressed in black from behind a tree at night?

oh yeah and peds are so annoying and my new hate scooters who which they were as thin as a bike and block all the bike sized gaps in traffic jams grrr...

back to peds - one yesterday was crossing then looked saw me and decided to not keep walking but stop in front of me, so every pedestrian after that was laughed at - oh i am mean

sometimes peds are cool, like this morning when a gust blew my cap off and one sprang into a busy road to retrieve it whilst i did a uey (sp?).

oh, and thanks to the guy riding behind me yesterday who stopped and picked up my phone that somehow sprang from my bag.

I wanted to know the law on pedestrian crossings. Do cars need to stop for people and cyclists?

I know that cyclists should probably dismount and walk their bicycle across the crossing; and shouldnt be cycling on the footpath. However I know of a few crossings in/by parks that have space for pedestrians and cyclists. Plus also thinking about kids/teenagers who seem to stick to footpaths; and some odd London road/bicycle path hybrid crossings.

From experience some drivers seem to even hestitate stopping for pedestrians let alone cyclists. Just feels some speed up when they see a cyclist crossing.

What's the law of the land?

If the junction is light controlled then traffic should be stopping at the red light anyway.
If it's a zebra crossing and you're pushing your bike then yes, they should stop and let you cross. If you're riding it then you are the traffic and should be stopping for pedestrians, not riding at 90 degrees to the road direction.
If it's not either, then it's not a crossing so I'm not sure there are any actual laws about giving way to anyone other than pedestrians.

Wondering about things takes up such a lot of energy don't you find?... If you buy a copy of the Highway Code for £1.99 you would actually know.. Admittedly the Code seems to be mere suggestion but it's better than nothing. You shouldn't really be on the road without one.

I love that drivers 'even hesitate' in your area! You obviously don't live in south London where they drive straight through.

I was hit yesterday evening by a pedestrian who stepped out into the road while the crossing light was red. I had the green light as I was going through the junction.

The impact from it threw me from my bike and I landed on my right side. Spent 3 hours in a&e, had x-rays and have been told nothing is broken but I have damaged the rotor cuff muscles on my right shoulder upto 2 weeks to heal. Bruised him, knee and ankle scraps and my helmet will need replacement. Haven't checked my bike over yet.

I have the details of the pedestrian as I took a picture of his drivers license. Police attended and took details, but the pedestrian had left, so they gave me a lift home.

Is it worth talking to a lawyer to claim for loss of earnings, replacement helmet and for any damage to my bike? I've had to call out of work for today and tomorrow.

There's no legal obligation for pedestrians to observe light controls, or indeed any other road controls save those that specifically prohibit pedestrian access. So really what this amounts to is whether you can persuade a court that the actions of the pedestrian were sufficiently responsible for the collision to hold them accountable and reasonably require them to pay for any incurred financial loss on your part.

In order to achieve that, you would probably need at least one credible, independent witness or CCTV footage of sufficient quality. If you don't have that, then you should be prepared that any costs incurred on engaging the services of a solicitor may not be returned. Before you go down that road, I would recommend that you look over the CAB advice on the Small Claims process as this is likely to be the most relevant legal path in your circumstances.

I am not a lawyer and any qualified legal advice would supersede mine.

An update to my previous post..

I have been in contacted, via email, with the pedestrian who knocked me off my bike. He is sending me a cheque to cover the cost of the replacement helmet and my loss of two days wages.

I don't think so (could be wrong), I'm glad that there is a positive outcome, but the onus is unfortunately on you rather the peds.
