There's plenty of instances of car drivers literally getting away with murder.
As I said to Manson7am, if you look at the Alliston case the logic is you have time to shout/blow an air horn, you have time to stop/avoid. So yeah, saying you blew your ridiculous air horn doesn't mitigate that...

Dupe or not, judging by this picture the guy seems to be a white supremacist. Seems appropriate.
What am I missing?
Is an upside down peace/CND symbol a neo Nazi symbol? Isn't it just mean to be edgy to have an upside down CND symbol on a military hat?...sort of like the way people used to wear German army parkas.

I think I did that deliberately after the new forum platform was introduced because I didn't want to be tagged in anything. I can't remember why now-just being a cunt probably...

Absolutely agree with that. But that is applying criminal sanctions to driving behavior, usually before a jury.
This is a civil claim, right?
Although I just read the Standard's coverage in the link above and the Judge said he wasn't riding like a cunt... kinda on the fence now.
-
• #56981
Don't civil claims have a lower standard of evidence for culpability tho?
Ianl but thought civil cases more geared to natural justice and financial settlements.
-
• #56982
but why if they are both responsible (which from what they say in the articles is crap anyway) is the cyclist the one having to pay compensation? surely natural justice is a slap on the wrists for both of them.
Maybe the Ped just had a cracking lawyer.
-
• #56983
I'm not a judge m8 but the article says the verdict was that ultimately the cyclist should have been able to anticipate and avoid, and given we know he saw her and had time to sound an air horn that seems fair enough. Also, swerving behind a ped is just asking for them to dodge backwards into you imhop, especially if you're sounding a massive airhorn at them. Both come across as fucking liabilities though...
I don't think she'll get much as she was partly liable and injuries minor, probably the lawyers fees will be the kick in the spiritual shitter...
-
• #56984
You are right, and i didnt understand that he would need to counter sued to get a payout, I was miss understanding of how courts like that work.
I suppose it's just the worry that the general public will read it and just think (yet again) that it always the cyclists fault, making it even harder to cycle about town.
-
• #56985
Tbh without reading the judgment it's all a bit meaningless. The media is hopelessly shambolic when it comes to reporting on anything legally related.
-
• #56986
And the level of compensation has not been set yet, so this could all be a lot of fuss over nothing.
-
• #56987
TBH if he lives in France now it's all a bit academic-any court mandated installment payments will be a pittance as well. You'd think that both having come off with similar injuries she'd just put it down to experience (or fucking karma even) and leave it be, unless there's been some horrific life impact not hinted at by the article beyond getting your favourite Lulu Lemon yoga pants soiled.
-
• #56988
Genuinely have you ever seen/heard anyone with an air horn on their bike who didn't ride like a massively aggro cunt?
Exactly my first thought as well.

The article suggest she has a head injury so who knows what the pay out could be. If could be massive, or a couple of thousand. If the cyclist had a home contents insurance policy the he’ll have at least 2 million lability cover. if not he needs to get a good lawyer and a medical report to confirm he has ptsd from the incident, given the 50/50 judgement he could end up making money from her.
Edit, the fact she managed to get solicitors to take the case would suggest that he does have some liability insurance so they know there going to get their costs paid and not by £1 a week for the next 3000 years.
-
• #56990
The mail article says she now expects to receives 'thousands', despite having minor injuries.
She's probably claiming as much as lost income as she can from yoga teaching or something.
-
• #56991
Even the most minor concussion would get somewhere in the region of £2,000. Perhaps the cyclist will be able to show he has greater injuries/ losses and she’ll end up owning him money.
-
• #56992
I'm just speculating out of my arse on the assumption that there must be something in it for her despite them having similar injuries.
So 50-50 is a bad outcome for them, you think they expected more?
-
• #56993
I think there's companies who hire in house instructors and offer yoga classes and one-on-one weekly sessions to staff as one of those perks of the job that just means you never leave the building, like them nap rooms at google or whatever. Definitely have a friend in a media company who has this in place so imagine finance companies are getting in on it too.
-
• #56995
50/50 in these circumstances, a personal injury claim rather than a damage to property claim is a very poor outcome for the injured party, it’s rare that a judge would put that much culpability on the injury party.
Her solicitors won’t be bothered are they will get there full costs now, as long as he has some kind of liability cover and as I say I doubt it would have got to this point if he didn’t have some cover.
The 50/5o judgement also means that she is responsible for 50% of his damages too, so if he has a medical report that says he has worse injuries than she does then she’ll owe him money.

as pathetically amusing as this tragically inept waste of skin and organs is, the surge in young white males clearly being radicalised on the internet to the point where thy feel compelled to arm themselves to the teeth with a view to slaughtering innocent people is an escalating fucking worry. it's time to start shutting websites like 4chan, the incel cunts, Qanon, reddit subs like t_d down. deplatform these fucks until the only way they can share their toxic shit is to crawl out of their neckbeard dens and do it in public at which point we can kick the shit out them until they're either a) dead or b) not fucking nazis anymore.

A Polish neo-Nazi who branded Prince Harry a race traitor for marrying
Meghan Markle and posted an image online with a gun pointed at his
head was jailed for more than four years. Michal Szewczuk, 19, posted
the sick image of the Duke of Sussex online with a gun to his head
against a blood-spattered background and the slogan ‘See ya later,

Martin Porter on twitter has pointed out he hasn't submitted a counter claim and it's now too late for him to do so as the incident occurred more than 3 years ago:

He didn’t do everything right tho, he carried on cycling and he hit her. If there’s someone in your path don’t try to guess which way they are going to dodge, just slam the brakes on.
That way you get to give them a withering ‘what the fuck are you doing you dithering dickhead?’ look instead of having to go to court.
