    As I said to Manson7am, if you look at the Alliston case the logic is you have time to shout/blow an air horn, you have time to stop/avoid. So yeah, saying you blew your ridiculous air horn doesn't mitigate that...

  • Absolutely agree with that. But that is applying criminal sanctions to driving behavior, usually before a jury.

    This is a civil claim, right?

    Although I just read the Standard's coverage in the link above and the Judge said he wasn't riding like a cunt... kinda on the fence now.

  • Don't civil claims have a lower standard of evidence for culpability tho?

    Ianl but thought civil cases more geared to natural justice and financial settlements.
