If you're already reversing and someone moves behind you, you can't just hit them because you'd already started.
Can you tell that the scrapes on your car run front to back as that would prove her hitting you rather than you hitting her whilst reversing.
If you've no NCB to worry about, claim against her.
Is there a car related insurance claims thread?!
I pull up to reverse parallel park into a space, there is a car in front of said space parked on double yellows, the driver is talking to a friend on the pavement and doesn't look to be moving. I have indicators on and start reversing into the space, driver then backs into me hitting my passenger side as i'm at a 45 degree angle. She looks at me with a look of "what?" on her face so i tell her to pull in so i can get her details. She then pulls the "did i hit you?" line (her friend has already walked into shop), i point at the scuff on my car and the damage on her bumper and tell her i need her details. She then gets her friend out of the shop and what follows was a tirade of entitled/how very dare you/you're a liar abuse. Things get momentarily heated between me and her male friend so i calm down and ask her again for her details. She tells me i'm being aggressive (i'm not) and says she's leaving (even her friend has told her to give details).
By then everyone has left and i check with shops and there's no cctv. As you should i report to my insurance and make an online police report. Police contact me yesterday and i ask them not to follow up (he stuck a phone camera in my face, i grabbed the camera and he scratched my face). I then call insurers today telling them that as per previous conversation i had no intention of making a claim as the damage is minimal. And then it drops...
She has made a claim against me, claims she was already reversing, guessing her reason for leaving without sharing details is that i was 2 or 3 levels below in the social chain.
Luckily i had my partner with me who is generally pretty quick to tell me if i'm being off with people but she's been clear with me that i wasn't. From insurers perspective they probably won't be able to apportion blame so i'll loose my no claims bonus.
Anything i can do to fix this?!
