You can read the report from the accident investigation beuro - G had nothing to do with it.
The plane was flown catastrophically badly.
So It looks like his defence was “I done a stupid that can only be explained by a special kind of mental impairment at the time”
Which seems like a nice get out of jail free card.
The problem with the 'I blacked out due to G force' argument is pilots flying fighter jets should know about G-force induced loss of consciousness (G-LOC) and, if you're flying at an air show, take steps to avoid it. So if he did black out due to G force, that's his fault, even if being a 1000ft too low was caused by G-LOC.
