To follow up on this; I just received the below from the lovely Met.

Dear Mr Tenners

Happy New Year to you.

The Registered Keeper of the offending vehicle failed to supply us with details of who was driving the vehicle at the time of the incident, therefore, the Registered Keeper was summonsed to court for the offence of failing to supply driver details. The registered keeper was fined and licence endorsed with penalty points and the case now closed.

Does this mean the driver was never prosecuted for the original offence of driving whilst using a mobile phone?

He was just charged with failing to supply details?

The driver might not have been charged at all. The driver might be 1 point away from a ban while the registered keeper had a clean licence and is prepared to take the points/fine for whatever reason.
