Why is the lever like that? How you gonna brake from the stem? Ew.
I've noticed a lot of bikes with similar setup being posted on instagram recently. I wondered if it was a case of fitting a brake in order to comply with the law but by fitting it in a manner where it is all but unusable to rebel against that law.

That's what I thought as well but it still looks stupid as fuck. Better to do something fun/non-hideous like this instead:
(spacer stack is anti so maybe it belongs here anyway)

For such purpose the seatpost-mounted brake lever was de rigueur back in 2007.
