  • It's a 2 month notice period regardless of when the notice is served. A section 21(1) notice can be served at any time before the end of the contractual end of the tenancy.

    Sorry I'm being really thick with this.

    In the eg above if you served on 15 Nov '18 would that mean that the tenant has to leave by 15 Jan '19 (15 Nov + 2m) or 28 Feb' 19 (AST end date of 30 Dec + 2m)?

  • 15th Jan. It's only if the notice is served after the end of the contractual term that it has to expire on the end of one of the rental periods. Section 21(4) is a very stupid law which gives no real benefit to tenants and simply provides pitfalls for honest but dim landlords. I thought it had been amended - evidently not. Bloody government's apparently busy with some bunfight with the EU. Useless gimps.

    Bear in mind date of service is not necessarily date of posting. If you want to make sure, put the notice in their hands personally.
