  • Question about an Assured Shorthold Tenancy from the Landlords POV.

    My understanding is that an AST is for a fixed term (usually a year), which then switches to a periodic tenancy requiring 2 month's notice from the landlord after the AST comes to an end.

    What I can't find anywhere is how much notice before the AST is due to end a Landlord needs to give ie - what is the minimum notice the landlord needs to give the tenant if they want them out on the last day of the AST?

    e.g. AST runs 1 Jan '18 - 31 Dec '18. Would notice need to be given by 31 Oct '18 latest?

    If notice was given on 15 Nov '18 what would be the consequence?

    If the window is missed and a Periodic Tenancy is created, would that require 2 months notice at the end of the AST - i.e 28 Feb?

  • It's a 2 month notice period regardless of when the notice is served. A section 21(1) notice can be served at any time before the end of the contractual end of the tenancy.

    Sorry I'm being really thick with this.

    In the eg above if you served on 15 Nov '18 would that mean that the tenant has to leave by 15 Jan '19 (15 Nov + 2m) or 28 Feb' 19 (AST end date of 30 Dec + 2m)?
