    Let me make clear a few points as people have been commenting on the sale of the two bikes I put on the forum.

    1. @velocio The dispute is not related to the Fuji bike. Still in respond to your comment, I never said in the post that the Fuji frame was "little bend", I said the frame was bend. Furthermore, I never intended to sell the Fuji as a road safe bike. If you have read my post accurately, I specifically and explicitly stated the bike was "For people who want the parts for restore project." If after having read this statement and someone still decided to buy and ride the bike without any restoration work, I can't be the person to take responsibility. Also, the condition of the bike was reflected in the price, if it was in perfect condition it would not have been sold for a merely £50/£60. I do not believe I have broken any forum rule as I did not misled anyone into buying the bikes, I have clearly provided high resolution photos and other information requested of the bikes for potential buyers.
    2. @Larkin I never assured you that the frame was not cracked. I was not a bike professional and I would not be in a position to comment on the status of the bike. What I have done was included a number of High Resolution photos of the bike for you to make the right decision yourself. I told you that "I think it is a scratch?". You have all the photos of the bike as everyone else on the forum. You also had access to inspect the bike before you made the conscious decision to buy the bike. I never forced you to enter into the trade nor provided you with any misleading information. I didn't at any stage withheld any information regarding the condition of the bike to my best knowledge. You even selectively disclosed information on the forum to other users, after I mentioned that I think the frame was not cracked, I did sent you another photo of the bike for you to make the decision.
    3. @Larkin With regards to the communication of the refund, I was out of the country on business and I needed to check when I could meet when I'm back in the country. I am not obliged to respond to your bombardment of messages 24/7. You made an educated and conscious decision on the purchase of the bike in light of information provided and comments from others on the forum, which you now regret. As a gesture of good will I did agreed to provide you with a refund even though there were no wrong doing from my part. There is no need to threaten me with words or actions, as evidenced in a screenshot of our conversation below, where you threatened me with my work and a ban on the forum. On that basis, as a result of your wrongful and untruthful accusation as well as your unnecessary threat I have decided against the refund. I should not be responsible for your decision which you now regret, you had access to informations and photos and you checked the bike before you bought it.

    Apart from selling a potentially life threatening bike in dangerous condition.

  • Meh. I don’t think he’s done that much wrong. It was clearly cracked. He said he didn’t know, couldn’t check but doesn’t think so. Guy had a look at it and bought it anyway

    You should refund buyer either way, regardless as to how they have acted. You seem to have somehow genuinely thought it was a scratch, and it turned out not to be, reducing the value of the frameset to basically nothing.

  • I'm not so sure- If I was selling something I didn't have a clue about that looked like it came from a scrapyard I would at least list as 'sold as seen', or reply "Sorry mate not sure, have a look" etc.

    Buyer not totally blameless though seeing as it was pointed out plain as day in this thread, most likely before he went to pick it up.

  • Bit of blame on both sides perhaps, but seller ultimately needs to make right and refund surely? Dick move to play the ‘Oh the sellers being mean so no refund now’. You sold him a death trap, squire.

  • @Frankie.L I understand you were away on business and you were busy but you got back last Monday...and you have been ignoring my texts and calls for a week now. I have not threatened you I have been messaging and asking you to sort this, to meet you, to come to your work and do anything I can to get this bike BACK to you.
    The only reason I persisted is because you said you would give me the refund and you have not been replying since then.

    You can’t just retract your offer...please don’t take this personally, I am just trying to get my money back. Despite the crack I have been sold an unsafe and unusable bike! And you said you were happy to refund me.

  • there is one thing I dont get here.

    did that bike arrive wrapped at the buyer's address and he had no chance to look at it before purchase ? buyer seemed well aware of the crack before going out to get that bike.

    Its not like it requires rocket science to see that fuji is done well neither .

  • Fuji was sold for parts that’s all good. Was a great price, Gave it to a friend and he was chuffed. I walked both the Bikes home as I knew I couldn’t ride the Fuji and ghost ride with the Olmo.
    So I didn’t test ride the Olmo when I bought it as I was juggling two home (silly me) but it’s cometely unrideable and unsafe. I was assured the “crack” was paint at the time of sale otherwise I wouldn’t have bought it. I couldn’t see the full extent of the crack until I removed the rear wheel at a friends bike shop a day later. That’s when I contacted @Frankie.L and he agreed to refund me due to the condition of the Olmo ✌🏼
    Hoping it will happen but not so sure now. No contact still :(

  • make sense, if there was reassurance from the seller that 'its NOT a crack' its only fair he takes it back.

  • Pretty much the only thing left is to add @Frankie.L to the list of bad traders to advise others to avoid trading with him in future.

    This does have the side-effect of being highly Googleable so will allow others who search for him via Google to see that they shouldn't buy anything from him.
