Just seen this thread. So pleased that you are recovering and hope the recovery continues swiftly and fully.
Would suggest speaking to a cycle injury solicitor soon and not to seek to repair bike until you have done so. There may be evidence in the bike that would help establish if the accident was the fault of the rack manufacturer.
