Or he could claim that having reached a decision and imposed a penalty the race jury was functus officio so far as the final sprint was concerned and therefore had no power to impose a new sanction or to review their original decision. I suspect the rules give them the right to review their decision, however.
The UCI were at pains to state that the disqualification was pursuant to a rule that gave them discretion. Unless Sagan can show that that discretion was exercised in an unlawful manner, it is impossible successfully to appeal a decision made through discretion. He would have to show bias or prejudice or some procedural irregularity. I suppose his best bet might be 'want of natural justice" insofar as they did not hear his take.
