  • Yvon Ledanois, ex-Movistar DS who was accused of being a client of Bernard Sainz whilst a rider. In the doping thread, Sainz is pictured arriving at court this week for a doping related trial with a Movistar Team issue suitcase!

    What are the chances?

  • I think the Rules specify black shorts with a championship jersey.

  • So news just coming out that someone, presumably Bora-Hansgrohe, have appealed Sagan's disqualification to the Court of Arbitration in Sport (aka CAS).

    I'm not sure what would happen if they ruled in Sagan's favour. But presumably the UCI's rules are robust enough to prevent CAS over-ruling them.

    The UCI were at pains to state that the disqualification was pursuant to a rule that gave them discretion. Unless Sagan can show that that discretion was exercised in an unlawful manner, it is impossible successfully to appeal a decision made through discretion. He would have to show bias or prejudice or some procedural irregularity. I suppose his best bet might be 'want of natural justice" insofar as they did not hear his take.

  • Or he could claim that having reached a decision and imposed a penalty the race jury was functus officio so far as the final sprint was concerned and therefore had no power to impose a new sanction or to review their original decision. I suspect the rules give them the right to review their decision, however.

  • The UCI director general is a qualified lawyer, so hopefully the rule book passed over his desk at some point.

    The Team and Peter Sagan, represented by their counsels Prof. Dr. Rainer Cherkeh (Hannover) and Dr. Maurice Courvoisier (Walder Wyss AG, Basel), have lodged an appeal with the CAS yesterday including an urgent motion to suspend the decision of the “Commissaires Panel” taken on late July 4, 2017 and confirmed by the President of the UCI.

    The Team and Peter Sagan would like to reiterate their position that Peter Sagan did not cause, let alone deliberately, the fall of Mark Cavendish on the last 200m of the fourth stage on July 4, 2017. Peter Sagan stayed on his line and could not see Mark Cavendish on the right side.

    Although the UCI CYCLING REGULATIONS provide unambiguously that it is mandatory to hear a rider before any disciplinary decision is taken (Rule 12.2.006: „The Commissaires Panel may judge the matter only if the offending party has had a chance to defend his point of view […]“), Peter Sagan has not been given an opportunity to explain to the „Commissaires Panel“ his point of view.

    If the motion to suspend, on which the CAS will have to decide now, is granted, Peter Sagan will immediately re-engage in the Tour and, together with the team BORA – hansgrohe, compete for a successful Tour de France 2017.
