I 'think' (@Velocio can advise) that if you've made very clear it is fake and it isn't safety critical you can flog them, but don't quote me on that. There clearly isn't any attempt to deceive here, and I have seen quite a few moody North face jackets get sold, although they may have slipped through the net....
