Yes - but it takes a while, so be warned. Also makes life easier if the driver is insured. And you have a lawyer.

Ride a road legal bike?
Heal up fast but beware if your bike isn't road legal it may be considered a contributory factor.
It's the same as a car that is not roadworthy.
