Yes, I have. And I can't even be bothered to point out all the differences. I edited my original remark to question how he obtained consent instead.

Do some reading. The answers are there.

You really have not read about this case at all have you? Worrying you have a strong opinion and don't seem to know the basis of the court case.

the following limbs to the prosecution case, that need to be established to prove rape:
(i) That X was not consenting (because she was incapable through intoxication);
(ii) That Evans did not reasonably believe X was consenting.
From Evans' version of events (asking to be tucked harder, etc.), or not saying no while also not realising she was too drunk to be able to consent.

You're actually defending a rapist??

This sums it up succinctly:
Northumbria police and crime commissioner Ms Baird, who was instrumental in bringing about the change in law, told the BBC's Today programme: "The only difference between a clear conviction of Mr Evans in 2012 and the absolute refusal of him having any leave to appeal at that time, and his acquittal now, is that he has called some men to throw discredit on [the woman's] sexual reputation.
Which is shit, no matter how you look at. Why were the witnesses not charged, if they'd done the same as a convicted (at the time) rapist.

Does seem very strange that a 'rape victim' would be sexually active again 2 weeks after the alleged attack
Some people deal with trauma by repeating the experience. They do the same (or as close as possible to the same) thing again (and over again) that traumatised them in the hope that it'll seem normal and nothing to worry about. That generally doesn't work for very serious trauma, I think. It can also take a long time, sometimes years, for a person to fully realise the impact of a traumatic experience, if they ever do.
I'm not saying any of that applies in this case, of which I have little knowledge beyond reading the secretbarrister link that MrDrem posted.

Yesterday in a retrial he was found not guilty = not a rapist

So if your missus has had consensual sex with you recently, and perhaps she has had consensual sex with other men before she met you, then her verdict is just that little bit weaker in court should she ever get raped.
Also, doggystyle isn't exactly a rare sexual practice. If a rapist can say in court that "we had sex in the missionary position" and the defence can find an ex who once shagged her in the missionary position, then her credibility is undermined?

"The cyclist was back on his bike again mere weeks after being hit by the bus. Clearly not very traumatised, one may wonder whether the cyclist was not, in fact, a consenting party to the traffic incident."
-
• #42865
Yeah, cos being knocked off a bike and being raped by two fellas at the same time are pretty similar, good analogy

McDonald had spoken to the woman and entered the hotel with her so consent was not so much an issue even though the hotel receptionist gave evidence that she was incoherent and insensible. Evidence he refused to change despite being reminded on Facebook by Evans' fiancee of a £50k reward for any information that exonerated Evans. Twice. Evans' own evidence was that he stepped over the insensible girl when she lay on the floor in the fast food joint, then lied to gain access to the hotel, had wordless sex with her then slunk out the back door hiding his face. So the issue of consent was different for the two men

Oh yes, it's that black and white in your world.
Are you that obtuse?
-
• #42868
Real gentlemen, obviously... So fucking creepy, and completely criminal behaviour in my eyes...
Pair of cunts, should lock them up and throw away the key... They might even get a taste of their own medicine while they're in there...

Imagine that Ched Evans actually did end up in the slammer, and then got into a spot of bother in the communal showers. A line of horny men eager to taste the fresh meat quickly line up and each take their turn. At some point Ched will give up protesting, perhaps withdrawing into his own mind when feeling too degraded or exhausted by what's happening. In Ched's own logic every man that butt-fucks him after than point can claim it is consesual sex.

The whole thing's awful, makes me sick...
Rape is so prevalent, the penalties need to be so much harsher... I know a lot of women who've been through it, I don't understand the mindset of any man who commits rape, it enrages me... Cut their fucking balls off AFAIC...
-
• #42871
Then his attackers give a statement to the police saying "It is what they like". Which is exactly what Evans did. Having taken no steps to gain consent at the time he retrospectively applies consent on behalf of the victim cos "It is what they like".
"It is not a normal thing but in the situation we're in these things happen"
His exact words.
-
• #42872
Ched Evans actually did end up in the slammer.
As much as he deserve the book to be thrown at him and I can understand your sentiment, I do not wish rape on anyone regardless of their crime.
-
• #42873
Retributional rape fantasy is fucking weird, stop it. (Even if it's to illustrate a point.)

Imagine that Ched Evans actually did end up in the slammer
No comment regarding the discussion here, but he was in prison for 2 and a half years after being found guilty the first time round...
