McDonald had spoken to the woman and entered the hotel with her so consent was not so much an issue even though the hotel receptionist gave evidence that she was incoherent and insensible. Evidence he refused to change despite being reminded on Facebook by Evans' fiancee of a £50k reward for any information that exonerated Evans. Twice. Evans' own evidence was that he stepped over the insensible girl when she lay on the floor in the fast food joint, then lied to gain access to the hotel, had wordless sex with her then slunk out the back door hiding his face. So the issue of consent was different for the two men
