I think its just a clever defense in court. But I call bullshit to it being in the passenger door. Phone on speaker only really works when its out in the open, which most likely means her lap.

More likely on her hand, holding the speaker part of the phone close to her mouth, a lots of people seemed to think that's a grey area.

I see loads of drivers holding their phones up to their chins, having dialled a number with their fingers, and chatting into it on speaker phone...assuming that's 'hands free'.
