I was thinking more of distraction by just talking to the passenger alone, but all that additional point is valid.

What do I know? I usually use sign language with the drivers.

I think its just a clever defense in court. But I call bullshit to it being in the passenger door. Phone on speaker only really works when its out in the open, which most likely means her lap.

More likely on her hand, holding the speaker part of the phone close to her mouth, a lots of people seemed to think that's a grey area.
