You're failing to see the point. The companies can make whatever the hell they want and then if anyone queries it they will 'make them available to the public' for some silly price and rules (kind of) remain adhered to.
They've always had custom bikes for the classics - bigger clearances, different suspension tricks and non-replaceable derailler hangers and stuff like that.
How do you know they're not available? If you inquire with the companies I'm sure they would be 'available' just like those £6000 helmets the British team used for the Olympics were available to the public.
