  • we have a share of freehold, us being upstairs in a VC - the downstairs neighbour has been reliably informed by our neighbour alongside us that she has detected signs of subsidence. hardly surprising considering the age of the property. As far as i understand it, yer man downstairs is responsible for downstairs-y goings on and we are responsible for upstairs-y goings on, like the roof. In the event of structural work needing to be performed, am i correct in my understanding that we are not liable for any costs incurred should this require any immediate attention, or am i being laughably naive?

  • I'd check the freehold agreement, but its my understanding that costs for any work are usually shared equally.

  • Yep, check the FH arrangement. Id def be hitting them up for the roof if they slung a bill for remedial ground work.

    How sure are they it is subsidence? Had a survey?

  • Depends what you've signed in your freehold obvs...

    If there is a whiff of subsidence I would be as thorough and collaborative as possible with your downstairs.
    Aside from the structural risk to the whole property (it won't just be downstairs whose walls and floors start to list) there is also the paperwork.
    If not addressed properly with a proper paper trail it can REALLY damage resale value.

  • I'm the upstairs flat in a victorian conversion. My lease has me responsbile for everything from the top of the ground floor upwards (which is an arse as I need a new roof).
