I can't speak for what the cyclist was actually feeling at the time but I think the cyclist's behaviour after the threat(s) serve as evidence that he didn't really believe there was any real intent behind the threat.
If I believed that someone was really threatening to kill me I wouldn't stick around to tell them to fuck off and call them a cunt.
S16 offences Agianst the Person act 1861:
Threats to kill:
"A person who without lawful excuse makes to another a threat, intending that that other would fear it would be carried out, to kill that other or a third person shall be guilty of an offence and liable on conviction on indictment to imprisonment for a term not exceeding ten years".
Doesn't matter if the Gimp meant it or not, if the cyclist believed it, or the Gimp meant for the cyclist to believe it then the offence is complete.
Result: £90 for Public Order. Justice: seen to be done...............
