• Don't let eBay drag it out. You may as well just open a dispute now as the first step is to contact the seller anyway, so you'll end up duplicating contact if you message him prior to dispute opening.

  • I've requested a return on the grounds they are not as described. Will see where it goes. Ebay will intervene if not resolved by the 9th. If I want to ride next week then I guess I'm going to have to buy another fork and take the risk that I'll get my money back on these.

  • Came to post about something else but since I was last poster I'll gove an update,

Opened an 'item not as described' case and seller was great, gave me a full refund and I saw later he relisted the forks with the leak etc disclosed within the listing and they sold for almost as much as I paid!

Now a new problem, I sold a WI freewheel on ebay, posted it on the 6th and got a message yesterday saying it hasn't arrived.

I thought the delay (3weeks) was a bit suspicious but buyer sounds genuine in his messages. I questioned the fact that I'd sent it to a shop and could it have been misplaced/misdirected and was happy enough with buyers responses.

I don't have the receipt for the (1st class small parcel) postage so cannot make a claim. There's no tracking with that service so can't trace it either. I've had to just refund the buyer.

What I do have though is receipts for other parcels posted more recently.

Would it be very out of line of me to claim that one of those has gone missing? I imagine that for an untracked service there's not much investigating that they can do and will just pay out. They owe me the compensation anyway so I don't really think I'm taking the piss too much but wouldn't want to get a postie into trouble for losing a parcel he really did deliver or anything.

  • Would it be very out of line of me to claim that one of those has gone missing?

    Yes.

And you know that already or you wouldn't be looking for someone to justify it.

With respect, posting sales without proof of delivery is a false economy: better 2nd class Signed For than 1st class and fingers crossed.

  • Yeah I think you're rigjt.

On both counts. 2nd class signed for from now on.

  • Sold some handlebars on ebay. Sent the wrong handlebars to the buyer, sent messages to try and rectify asking for them to return them to me so I could send the right ones. Obvs offering to pay postage.
Didn't hear owt so assumed they wanted to keep the others. So I re-sold the handlebars they won.
Now I have noticed they have opened a paypal dispute to get their ££ back. Paypal have taken the funds from me and they are on hold.
I can't address the case as their ebay account is on the German site which ebay uk directs me to.
So they currently have a set of my handlebars (the wrong ones I sent out) and potentially a full refund.
    What can I do?

  • Have they opened the dispute as 'item not received' or 'item not as described'?

Is it a paypal disute or an ebay one?

If ebay, you should just work through the resolution centre and shouldn't matter where their account is registered.

Would have thought Paypal would work similarly.

Get in touch with customer services for whichever it is through if you are having issues resolving it because of the German thing, they are there to help.

  • They have opened a dispute but when i click on it, it just takes me to the login for German ebay so i can't respond??

  • Your log in details don't work?

Im sure I've logged into ebay.com with my ebay.co.uk details so might work the same?

When you say "...but when I click on it.." where are you clicking on the dispute from?

If you are clicking on it in the resolution centre while logged in and it's asking you to sign into german ebay and you can't get any further then I'd contact ebay customer services. I've used the live chat and the call back thing for a few problems and always found them pretty helpful.

  • Ah ok I'll try live chat later thanks

  • Sold an item on ebay, winning buyer messaged me a couple of days later to say can I cancel the sale as he no longer wants it, he had a sniper on two items the same and won them both. Am I better to cancel the transaction or open an unpaid item report? (FYI I am new toselling on ebay)

  • Imo its just best to cancel it. Even if the buyer just regretted his bet and won regardless its easier for both of you to just let go. If you push he might accept and then come up with a bogus reason why he want to return it as "not as described" etc, just not worth the risk / hazzle.

Lots of nice guys to sell stuff to so don't need to bother with guys like that imo.

  • Yes that sounds sensible, I was just concerned that I may get a bad reputation score for cancelling a sale or if he would have any further come backs in the future

  • Cancel it and stick the buyer on your block list.

  • Whats the deal if I want to buy from Ebay Italy? Do I need another seperate account my login (.co.uk) doesnt seem to work.

  • If you log in to your UK account and search for the item worldwide it should come up...bought something from Italy recently myself....

  • Just curious for opinions. I am asking the question in relation to a second hand balance bike. It was described as well used with chips to frame etc. It was also described as "perfect working order". What would you expect from a balance bike described as "working order"? What would you expect from a balance bike described as "perfect working order"?

[As an aside I am delighted with the purchase - got it for much less than I would have paid given its condition, but I am still really fucked off as a matter of principal about the way it was described].

  • Well perfect working order would be that the moving parts move and the nonmoving parts stay still... it's a balance bike so has 2 wheels and a you can steer it a little so not much to go wrong.

  • Mmmm... I disagree. I would say that "working order" would be that the moving parts move and the non-moving parts stay still. I would say that "perfect working order" means that the moving parts move freely and exactly as they should - perhaps as if they were new or had just been serviced.

The headset and rear wheel are alright and very useable, spin pretty good but a little rough... working order not perfect working order. The front wheel's bearings are pretty tight (and possibl fucked) meaning that the front wheel barely completes 2 revolutions if you spin it freely by hand. I'd argue that this is 'useable order' as opposed to 'working order' (and I'd have some sympathy with someone saying that it is not even useable - a balance bike is meant to encourage cycling not leave kids hating two wheels because it is a struggle). It is certainly not 'perfect working order'.

Why use the word "perfect" before "working order" other than to say "this is not just working, it is working to perfection"? Surely if the moving part is a bearing designed to move freely then working order is "moving freely". Surely if you want to describe it as perfect working order it should be moving freely and also smoothly?

The guy really pissed me off... fucking moron... I genuinely would have paid double the price in its current condition, but the stupid fucker has managed to flog it for £20 less than he could have got whilst also pissing the buyer off.

  • Given that a large number of balance bikes don't even have bearings and everything moves on crappy plastic bushes, are your expectations perhaps a little great?

  • Also, saving £20 on what you were willing to pay and then still moaning about it?....

  • It is not the biggest problem ever and I left positive feedback because I was overall happy (but in many respects I feel bad about doing that because the guy is a liar on his listins so deserves negative feedback).

I was curious to hear opinions. It seems to me that people seem to think that "perfect working order" is the same thing as "a bit fucked but basically works". People seem to think that just because many balance bikes are shit one shouldn't expect a good quality one described as "perfect working order" to be in "perfect working order". People seem to think that misleading listings are fine so long as the end product is good value.

Fair enough, I'm the mad one.

But seriously, your responses do help me understand why people would be quite happy to lie on their listing and not feel guilty about it.

  • You are Jeez AICMFP!

  • He rises! It's an Easter miracle.

  • If the bike was a decent quality one with actual bearings and stuff and those bearings are now bugger fucked then don't moan here, open a case on ebay/paypal.

I'm perhaps making massive presumptions but it sounds like you bought a balance bike, weren't too happy with the quality so are having a whinge. In which case, either go to a shop so that you can see the bike you are buying or buy a new one off tinternet such that distance selling regs apply and you can return if you aren't satisfied.

Don't buy used on ebay then moan coz they quality int all that.
