    Yeah totally, but as it says on the diagram, "do not cross". I know it's not there for legality but it is there to make crossing as safe as possible.

  • I know that you really, really want peds to GetTehFuckOutOfTehWay, but you've got to that viewpoint by taking the sort of motor-centric view that's made the roads so dangerous for everyone (including cyclists) over the last few decades.

  • I treat all the peds as if they would be children. Lots of the arguements above take a different shape when you swap them for an unknowing child. In central london it's almost always a group of peds waiting to cross so imagine your view of the child who runs out is obscured.

  • I was having a chat last night in le pub with my mate, she's a PE teacher and did a cycle course with the kids and also a green cross code thing to.

    And errr.. It was explained to me that peds have absolutely no obligation to stay on the pavement when the red man light is on at a pedestrian crossing. She just teaches kids that you can't so they don't get run over..

    Plus if a ped jumps out in front of you last second then basically tough shit and the only reason it scares the living shit out me so much is that in comparison to a 4 wheeled motorist a cyclist can and usually does come off a lot worse in a ped collision.

    It also doesn't matter if it wasn't your fault, meaning it was proved that the motorist/cyclist was using the road with "due care" when the incident happened.

    The only time when the ped would be considered as wrong is if they show "due negligence" aka they are pissed out of their face and that's about it.

    Even then they wouldn't be liable for damages as peds aren't insured.

    With regard to the initial conversation I should have just replied to your speculation with "the cyclist in the tragic case above was proved to be cycling with due care or he would be in a jail cell right now".

  • Yeah you might be, because that's where I was originally coming from.

    From a safety aspect hoping off the pavement on a "red man signal" isn't a brilliant idea obviously.

    But strictly speaking from a legal perspective the ped can never be considered as "wrong" unless they are considered "negligent" which is very hard to prove in court.

    From an emotional view, peds crossing on red man can be argued as wrong but it is an invalid argument because it's not illegal. (this is where I was wrong)

    Legally it all boils down to the road user, either the motorist/cyclist is guilty or not guilty of "driving without due care". If they are found innocent it's basically like saying it wasn't your fault, it was the peds fault for jumping out but because the ped is not legally obliged to wait at the "red man signal" the ped can never be wrong.

    I know its weird but that's the law.

    *though I rely on that for weaving through hoards of commuter peds in the mornings, seen a lot of them walk into the sides of buses and taxis before, so shows its not just they are blind to bikes, people often just do not look at all.

    ...plus a whole lot of other shit, like accepting that the majority of cyclists don't like doing the West Way/Hyde Park Corner/Vauxhall etc. for laughs and that I'm the one that's a minority in the grand scheme of cycling in London.

  • Most peds will have personal liability insurance as part of there household contents insurance policy which will have at least 2million cover, just the same a third party liability insurance for cars. It also covers you as a cyclist (as long as your not racing)

  • Watched two peds follow each other across a busy road almost being hit by a bus. Both stood there just staring at the bus, while bus driver was giving them the horn.
