pot hole crash

So I came off my bike yesterday as I hit a pothole. Bike is ok. I'm ok bruised and battered with a small fracture to my left elbow. I probably cannot work for a little bit. I am not one for the claim lawyer thing but I wondered if the council are responsible for this as the thing is not marked. Any experience?

Bikeline. Dealing with them at the moment and they're definitely not ambulance chasers. I guess if a pothole has been reported to the council and not dealt with then you've got a genuine grievance.
