Just got a letter from CPS explaining their decision not to prosecute the driver.
They explain that although the CCTV shows the driver hitting me and the sole witness claiming they were driving erratically and to blame for the accident.. there was 'not enough evidence to prosecute' they then mention that I am 'in the middle of the road' and nearly struck by other vehicles (no idea which ones they are talking about)
How do I appeal a CPS decision?
Do I have the right to the results of breath test on the driver?
